WHAT IS MDP
MDP is an association of highly trained and experienced
physician and attorney dispute resolution specialists working together in
Co-Mediation, Co-Arbitration, and Educational Processes, dedicated to the
prevention and non-adversarial management of healthcare disputes.
THE MDP APPROACH
MDP is a multifaceted organization dedicated to the creative and
cost-effective resolution of disputes in the healthcare industry.
WHY MDP?
MDP uses physician and attorney teams in Co-Mediation, Co-Arbitration, and
Educational Processes, promoting optimal communication of issues involved in
healthcare disputes.

In medical malpractice disputes, the physician panelist is able to interpret
highly technical medical aspects, and translate this information to the less
informed parties, while helping the medical professionals communicate their
concerns and issues to be better heard and understood. Unlike the physician
hired by the advocates as an expert witness, the physician neutral is there to
discuss medical issues in an unbiased and informative manner.
The attorney panelist facilitates a fluid and productive mediation process and,
where appropriate, assists the parties in reaching agreement through the use of
a range of "closing" techniques. Using claims valuation analysis and other
approaches, the attorney panelist also acts as a neutral resource to help the
parties gain a realistic sense of the prospects and consequences of litigation
should the parties choose that course over a negotiated resolution.
Both the physician and the attorney panelists are trained and experienced in a
broad range of potential resolution mechanisms other than simple monetary
exchanges. The combination of physician and attorney panelists assures that both
the medical and legal issues of disputes are fully addressed, leading to
satisfying, and sometimes, imaginative resolutions.
